Terms of Service

Please read these Terms of Service carefully before using fltrIT. By creating an account or using any part of our platform, you agree to be bound by these terms.

1. About fltrIT

fltrIT (“we,” “us,” or “the Platform”) is an online marketplace operated by fltrIT, LLC that connects Epic-certified healthcare IT consultants with healthcare organizations, health systems, recruiting firms, and other employers (“Employers”). fltrIT is a neutral marketplace — we do not employ consultants, place workers, or act as a staffing agency. We provide the tools and infrastructure for Employers and Consultants to find and connect with each other.

2. Eligibility and Account Registration

You must be at least 18 years old and legally authorized to work or conduct business in your jurisdiction to use fltrIT. By creating an account, you represent and warrant that:

  • All registration information you provide is accurate and complete
  • You will maintain the accuracy of your information
  • Your use of the Platform does not violate any applicable law or regulation
  • You are not prohibited from receiving services under applicable laws

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@fltrit.com if you suspect unauthorized access.

3. Credential Submissions and Self-Attestation

Important — Please Read

fltrIT does not independently verify Epic certifications, credentials, or employment history with Epic Systems Corporation or any other third party. All credentials displayed on consultant profiles are self-reported by the consultant and/or submitted by endorsers nominated by the consultant.

By submitting credentials, certifications, work history, endorsements, or any supporting documentation (including screenshots, certificates, or attestation statements) to fltrIT, you represent and warrant that:

  • All submitted information is accurate, current, and not misleading
  • You have the right to submit the documentation you upload
  • You are not misrepresenting your qualifications, experience, or certifications
  • Screenshots or documents submitted as proof of certification are authentic and unaltered
  • You will promptly update your profile if any credential expires, is revoked, or becomes inaccurate

Submitting false, misleading, or fraudulent credentials is a material breach of these Terms and may result in immediate account termination, removal from the Platform, and notification to relevant parties. fltrIT reserves the right to remove any profile or listing that it believes in good faith contains inaccurate or fraudulent information.

Employers acknowledge that fltrIT is a self-attestation marketplace. Employers are solely responsible for independently verifying any credentials, qualifications, or representations made by consultants before entering into any engagement, contract, or hiring decision. fltrIT expressly disclaims any warranty regarding the accuracy or completeness of consultant credentials.

4. Peer Endorsements and References

The endorsement and verification system on fltrIT allows third parties to submit statements about a consultant's professional qualifications and conduct. By submitting an endorsement or reference, you represent that:

  • You have direct, first-hand professional experience with the consultant you are endorsing
  • Your statement is truthful and based on genuine personal knowledge
  • You are not being compensated or incentivized to provide a positive endorsement
  • Your statement does not defame, harass, or make false claims about any person

All endorsements are subject to review and approval by fltrIT before publication. fltrIT reserves the right to reject, remove, or edit endorsements that violate these Terms or that we determine in good faith to be inaccurate or inappropriate.

5. Employer Responsibilities

Employers using fltrIT agree to:

  • Post only legitimate, real job opportunities or engage in genuine hiring activity
  • Use consultant contact information obtained through profile unlocks solely for legitimate hiring and engagement purposes
  • Not share, resell, or distribute consultant contact information to third parties
  • Conduct their own independent verification of consultant credentials before hiring
  • Comply with all applicable employment, contracting, and anti-discrimination laws
  • Not use the Platform to harvest data, scrape profiles, or build competing databases

6. Payments and Subscriptions

Certain features of fltrIT require payment, including employer subscription plans and profile unlock credits. By purchasing a subscription or credits, you agree to:

  • Pay all fees at the rates in effect at the time of purchase
  • Provide accurate and complete billing information
  • Authorize fltrIT to charge your payment method on a recurring basis for subscription plans

Subscription fees are billed monthly or annually in advance and are non-refundable except as required by applicable law or as expressly stated in our refund policy. Profile unlock credits are non-refundable once used. We reserve the right to change our pricing with 30 days' notice to active subscribers.

Payments are processed by Stripe, Inc. Your use of Stripe's services is subject to Stripe's terms of service. fltrIT does not store complete payment card information.

7. Prohibited Conduct

You agree not to:

  • Submit false, misleading, or fraudulent information of any kind
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Platform for any unlawful purpose
  • Harass, threaten, or harm other users
  • Scrape, crawl, or systematically extract data from the Platform
  • Interfere with or disrupt the Platform's infrastructure or security
  • Attempt to gain unauthorized access to any account or system
  • Use the Platform to send spam or unsolicited communications
  • Circumvent any access controls or usage restrictions

8. Intellectual Property

The fltrIT platform, including its design, code, trademarks, and content created by fltrIT, is owned by fltrIT, LLC and protected by applicable intellectual property laws.

You retain ownership of content you submit to fltrIT (your profile information, credentials, bio, etc.). By submitting content, you grant fltrIT a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content solely for the purpose of operating the Platform and providing our services.

fltrIT is not affiliated with, endorsed by, or sponsored by Epic Systems Corporation. “Epic,” “MyChart,” and other Epic product names are trademarks of Epic Systems Corporation and are used on this Platform for descriptive and identification purposes only.

9. Privacy

Your use of fltrIT is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

10. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

FLTRIT DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY CONSULTANT CREDENTIALS OR REPRESENTATIONS ARE ACCURATE; (C) ANY EMPLOYER POSTINGS ARE LEGITIMATE; OR (D) THE PLATFORM WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLTRIT'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FLTRIT IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). IN NO EVENT SHALL FLTRIT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless fltrIT, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your submission of false or misleading credentials or information; (d) your violation of any third-party rights; or (e) any hiring or engagement decision you make based on information obtained through the Platform.

12. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may terminate your account at any time by contacting us at hello@fltrit.com. Upon termination, your right to use the Platform ceases immediately. Sections 3, 8, 10, 11, and 13 survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.

These Terms of Service constitute the entire agreement between you and fltrIT, LLC regarding your use of the Platform and supersede all prior agreements.
